SUMMARY meeting Friday, 02/15/2008
Mr. Dominique Calmet we presented, namely:

- the functions of notary:
The notary Polynesian exists as we can the hear in these current position since 1950.
The notary is a public officer entrusted with a part of the public. He practices in the context of a profession. It may be incidentally judicial officer acting pursuant to a court decision.
The notary drafts the agreements of the parties in a deed received by him and which has the force of law between the parties. It carries out its duties impartially because it must inform each party to the act of the scope of rights and obligations.
The act thus received is kept by the notary drawing and it has a character of public records.

- The problem of land in French Polynesia - problems:
o The vagueness of the description of goods in tomite (declaration of land)

o The need for legislation adapted to the specificities of French Polynesia

The absence of systematic settlement of estates,

o The lack of transcription of some private deeds or judgments,

- Access to Law in French Polynesia
Me Calmet reiterated the need for the creation of the House of Justice and the law to allow individuals to have access to legal information, because despite the regulatory outcome of the deliberation No. 2002-162 APF of 5 December 2002 regulating the legal advice and drafting of private deeds, some litigants may not have access to legal professionals and can still be "canvassed" by unqualified persons.
